Terms of Service

The agreement
These terms are an agreement between you and Zenon Davis, who operates Cardelle ("Cardelle", "we", "us"). "You" means the grooming business using Cardelle and the staff it gives access to. By using Cardelle you agree to these terms and to the Privacy Policy.
The service
Cardelle is software for running a dog grooming business: scheduling, client and pet records, intake, text messaging, leads, payment matching and reports. It's early and invitation-only. Features will change as it grows, and we'll tell you before removing something you rely on.
Your account
You're responsible for the staff accounts you create, for keeping passwords private, and for what happens under your account. Tell us right away at the address below if you think an account has been misused.
Your data
Your business's data, including your customers' and their pets' information, stays yours. You give us permission to store and process it only to run Cardelle for you, as the Privacy Policy describes. You're responsible for having the right to the information you put in, and for your own privacy notice to your customers.
Text messages and calls
You're responsible for how your business uses texting and calling through Cardelle: getting your customers' consent before automated texts, honoring opt-outs, and following the laws and carrier rules that apply (such as the Telephone Consumer Protection Act and the CTIA guidelines). Cardelle helps by recording consent and handling STOP and HELP replies, but you choose what to send and to whom. Don't use Cardelle to send marketing to people who haven't agreed to it.
Other services
Cardelle connects to services you have your own agreements with, such as Poynt for card payments, Twilio for your business number, and Google for Local Services Ads. Cardelle doesn't process payments; your point-of-sale provider does. Those services are governed by their own terms, and we're not responsible for them.
Acceptable use
Don't use Cardelle to break the law, send spam or harassing messages, upload anything you don't have the right to, try to get into another shop's data or other accounts, interfere with the service or its security, or copy the service to build a competing one.
Fees
Cardelle is free during this early period. If we introduce fees, we'll give you at least 30 days' notice, and you can stop using Cardelle before they apply.
Availability and support
We work to keep Cardelle running and to help when something goes wrong, but we can't promise it will always be available or free of errors. Keep your own records of anything you can't afford to lose.
Ending the agreement
You can stop using Cardelle at any time. We may suspend or end access if these terms are broken or to protect other users or the service. When an account ends, you can ask for a copy of your data within 30 days; after that it's deleted as the Privacy Policy describes.
Disclaimers and limits
Cardelle is provided "as is", without warranties of any kind, to the extent the law allows. To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits or data, and our total liability for any claim about Cardelle is limited to the greater of the amount you paid us in the 12 months before the claim or $100.
You agree to cover claims brought against us that arise from the content you put into Cardelle or the messages your business sends through it.
Law, changes and contact
California law governs these terms, and disputes go to the courts of California. If we change these terms, we'll post the new version here with a new effective date and tell you about significant changes before they apply; continuing to use Cardelle after that means you accept them.
